Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the ForeLeaf mobile applications, the website at tryforeleaf.com, and related services (collectively, the “Service”), operated by ForeLeaf (“we,” “us”).

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The marketplace model

ForeLeaf is an online marketplace that connects homeowners (“Homeowners”) seeking home and outdoor services with independent service professionals (“Pros”) who provide those services. ForeLeaf does not provide home services itself. Pros are independent contractors and not employees, agents, partners, or joint venturers of ForeLeaf.

ForeLeaf does not control, supervise, or direct the manner or means by which a Pro performs services. ForeLeaf does not guarantee the quality, safety, or legality of services performed by Pros, the truth or accuracy of any listing, or the ability of any Pro or Homeowner to complete a transaction.

2. Eligibility

You must be at least 18 years old, have the legal capacity to enter contracts, and reside in a service area where ForeLeaf operates. By creating an account, you represent that all of the above is true. We may suspend or terminate accounts that violate this section.

3. Account responsibility

You are responsible for safeguarding your account credentials and for all activity under your account. Notify us immediately at support@tryforeleaf.com if you suspect unauthorized access.

4. Bookings, pricing, and payments

4.1 Flat pricing

ForeLeaf publishes flat prices for supported services. The price you see at booking is the price you will be charged for the scope shown. If a job requires work beyond the booked scope, your Pro will request an add-on through the app, which you must approve before any additional work or charge is incurred.

4.2 Payment authorization

By booking a service, you authorize ForeLeaf (through our payment processor) to charge your payment method for the booking total, any approved add-ons, applicable taxes, the homeowner service fee, and any cancellation or no-show fees described below.

If a Pro fails to perform agreed work, or performs it substantially below industry standard, you may submit a refund request through the app within 72 hours of job completion. We will review evidence (photos, messages, GPS records) and issue refunds at our reasonable discretion. Disputes that cannot be resolved through our internal process are subject to the dispute-resolution provisions in Section 13.

ForeLeaf charges a service fee to Homeowners on each booking, currently 10% of the booking total, capped at $15 per booking. Pros pay a flat monthly subscription to access the platform, disclosed during onboarding. ForeLeaf does not take a percentage cut of completed bookings from Pros. Fees may change with at least 30 days’ notice.

9. Reviews

Homeowners and Pros may post reviews of each other after completed jobs. Reviews must be honest, based on first-hand experience of the specific booking, and free of harassment, threats, hate speech, or false statements of fact. ForeLeaf may remove reviews that violate this section.

10. Intellectual property

The Service, including all software, branding, and content, is owned by ForeLeaf or its licensors and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. You retain ownership of content you submit (photos, reviews, messages); by submitting it, you grant us a non-exclusive, royalty-free, worldwide license to use that content to operate and improve the Service.

11. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

FORELEAF DOES NOT WARRANT THE WORK PERFORMED BY ANY PRO. PROS ARE INDEPENDENT CONTRACTORS RESPONSIBLE FOR THEIR OWN WORK PRODUCT AND COMPLIANCE WITH LAW.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FORELEAF, ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID FORELEAF IN THE 90 DAYS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) $100.

13. Dispute resolution

You and ForeLeaf agree to first attempt to resolve any dispute informally by emailing support@tryforeleaf.com. If we cannot resolve the dispute within 30 days, either party may pursue binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will take place in Jackson County, Missouri, in English. You and ForeLeaf each waive any right to a jury trial or to participate in a class action. You may opt out of this arbitration provision by emailing support@tryforeleaf.com with the subject “Arbitration Opt-Out” within 30 days of first accepting these Terms.

14. Termination

You may stop using the Service at any time and may delete your account by emailing support@tryforeleaf.com. We may suspend or terminate your account at any time for violation of these Terms, fraud, or risk to other users. Sections that by their nature should survive termination (including Sections 10, 11, 12, 13, and 15) will survive.

15. Governing law

These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-laws principles. Subject to Section 13, any litigation must be brought in the state or federal courts located in Jackson County, Missouri.

16. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notice at least seven (7) days before they take effect. Continued use of the Service after a change indicates acceptance.
